'Dancing with the Stars' pro Val Chmerkovskiy sued by 16-year-old girl with Down Syndrome

Dancing with the Stars professional dancer, Val Chmerkovskiy, is being sued by a teenager with Down Syndrome after he posted a meme with her photo on it earlier this month.

The 16-year-old girl is suing Chmerkovskiy for $6 million in damages for emotional distress caused by the photo, which mocks her weight. She’s also suing the original photographer of the photo, which is from a baseball game in 2008, for $600,000. She also wants $6 million from CBS News, who also posted the meme.

She’s suing on defamation, emotional distress and invasion of privacy charges, TMZ reports.

The caption of the meme, which shows the girl drinking a soda, is "Letting your kid become obese should be considered child abuse." Her mother then reportedly sent an email to Chmerkovskiy asking for him to take it down, claiming she’s overweight because of her condition.

The girl’s sister told WKRN when Chmerkovskiy first posted the meme, “I couldn’t believe it when I saw it; makes me wonder what kind of people are out there. It makes me sick.”
