Pennsylvania couple wants to get married, but they are father and son legally

A Pennsylvania couple wants to get married and that should be no problem for them, now that same-sex marriage is legal across the country. The only problem is that they are legally father and son.

Roland ‘Drew’ Bosee Jr., 68, and Nino Esposito, 78, have been together 42 years. In 2012, they gave up on the idea that Pennsylvania would ever legalize same-sex marriage, so Esposito decided to adopt Bosee as his son in 2012. Unfortunately, this means that they can’t get married since they are legally father and son.

“We just wanted some legitimacy and be connected and be a family, Esposito told People Magazine.

The couple is now seeking to have the adoption annulled and first petitioned to an Allegheny County judge. The request was denied and the judge said that the adoption laws would not allow for it. They appealed to Superior Court and oral arguments will start next month.

Esposito and Bosee told CNN that they knew of other couples in similar situations and they were able to annul adoptions so they could marry. The couple have been fighting for the same instance since May 2014, when the state legalized same-sex marriage.

“We realized we could have a complete union, which is what we want,” Esposito told CNN.

Pennsylvania Sen. Bob Casey has already written to the U.S. Justice Department to ask if they could take a stand on the case. A Justice Department spokeswoman told CNN that they are reviewing the request.
